A clear guide to avoiding fraud when buying property in Morocco

Anyone seeking to avoid fraud when buying property in Morocco needs not blanket suspicion but a consistent due-diligence process. The seller’s identity, proof of ownership, encumbrances, powers of attorney, areas and payment route are independently confirmed before any binding commitment or larger payment. Time pressure, an exceptionally low price or claims of other prospective buyers are reasons for more scrutiny, not less. Conversations, advertisements and screenshots do not have the evidentiary value of current official documents. A likeable intermediary is also no substitute for the notary or specialist technical review.

This guide presents warning signs and organisational safeguards for buyers from abroad. It does not allege improper conduct by any party and is not legal advice. DACHMA can request documents, maintain question lists and coordinate appointments. The appointed Moroccan notary and other qualified advisers assess ownership, contract drafting and payment processing. Technical specialists inspect the building and visible existing structures. Decisions are made only once outstanding points have been clarified in writing or documented as a consciously accepted risk.

Review points

Five decisions that make the difference

01

Confirm identity and authority to represent

The name and identity of the person selling must match the ownership documents. If someone acts under a power of attorney, its scope, form, validity and possible restrictions are checked by the notary. For companies, authority to represent and current corporate documents are added. Payments to third parties who are not clearly authorised are not a normal substitute for an orderly process.

02

Obtain the current ownership status

An old document or a copy from a chat is not sufficient. The notary clarifies the current land-register and cadastral status, registered rights, encumbrances and exact description of the property. For unregistered title or complex ownership situations, the due-diligence requirement changes materially; verbal assurances must not close this gap.

03

Reconcile the area and visible existing structures

The brochure, contract, land register, plans and actual rooms may state different areas. Terraces, parking spaces, ancillary rooms and later extensions are allocated individually. A technical specialist or surveyor can document discrepancies. Only then can it be assessed what is legally included in the sale and which part may remain unresolved.

04

Structure payments traceably

The reservation, deposit, remaining purchase price and ancillary costs are each assigned a written purpose, recipient and due date. Bank receipts and evidence of source of funds are retained. The notary explains the proposed process. Cash, private intermediary accounts or pressure to pay before reviewing documents increase risk and should not be accepted for convenience.

05

Replace promises with specialist review

Statements such as approved, debt-free, immediately lettable or fully renovated are verified using suitable documents and review assignments. The legal position, tax and technical matters belong to different specialist fields. A positive finding in one area says nothing automatically about the others. Outstanding questions remain on a list until a reliable answer is available.

Process

From the initial objective to a regulated next step

01

Clarify the objective and budget

For the ‘avoid fraud when buying property in Morocco’ project, intended use, region, property type, timeframe and total costs are defined in writing.

02

Narrow the search area

Determine micro-locations, everyday life, exclusion criteria and realistic alternatives.

03

Listings and viewing

Pre-filter information, consolidate appointments and document observations in a traceable manner.

04

Price and documents

Negotiate terms and have ownership, encumbrances, construction, use and costs reviewed separately.

05

Contract and payment

Coordinate the notary, specialist advisers, bank, deadlines, payment route and handover unambiguously.

06

Handover and management

Organise keys, the report, utilities, defects, inspections and letting as needed.

State risks realistically

What must be clarified before making a commitment

Risks do not arise only from forged documents. Incomplete information, misunderstandings, discrepancies in floor area, informal alterations or unresolved costs are more common. Even genuine documents may be outdated or may not describe the property viewed. A rushed reservation can weaken negotiating leverage and the ability to recover payments. Absolute certainty cannot be promised; however, an independent, multi-stage process reduces avoidable errors and makes remaining risks visible.

Professional limitations remain visible

Due diligence and coordination reduce information gaps. They replace neither individual review nor the responsibility of the relevant specialists.

Next step

Submit a qualified enquiry

Before the first payment, create a data room containing identity, ownership documents, the floor plan, areas, powers of attorney, costs and draft contracts. For every point, identify who will review it and which answer is required. DACHMA can coordinate this process while the notary and specialists document their respective findings. If time pressure is applied or a review is refused, the process is paused rather than improvised.

Decision-making in practice

Questions before making a commitment: Avoiding fraud when buying property in Morocco

A sound purchase process combines several perspectives. A financially appropriate price is insufficient if ownership, use or condition remains unresolved. Conversely, a legally sound property does not automatically become the right choice if the location, everyday life and ongoing costs do not suit the buyer. Facts, assumptions and personal preferences are therefore documented separately.

Before making a reservation, it should be clear which documents are already available, which reviews remain open and who will undertake them. Every assurance receives a source or remains expressly marked as an assumption. This applies particularly to rental potential, renovation, construction progress, permissions and future infrastructure. Decisions under artificial time pressure do not fit this approach.

What DACHMA contributes specifically

DACHMA structures German-language communication, assists with selection and viewings, prepares negotiation and due-diligence questions, and coordinates agreed steps through to handover. The responsibility of external specialists remains visible. The buyer therefore knows who made a statement and what its scope is. This transparency is more important than a blanket promise that everything has been ‘verified’.

How a decision is documented

For serious candidates, advantages, unresolved points, costs, documents, responsibilities and deadlines are brought together. A decision follows only when material risks are understood. This may mean requesting further documents, commissioning a technical inspection, renegotiating terms or stepping away from a property. Ending the process can also be a good outcome.

Frequently asked questions

Frequently asked questions: Avoiding fraud when buying property in Morocco

Is a notarial purchase automatically risk-free?

No. The notary is central to the legal transaction, but condition, financial viability and personal suitability require additional reviews.

Should I pay a reservation fee?

Only after reviewing the recipient, purpose, repayment rules and written agreement. The notary should assess the planned structure in advance.

How can I recognise forged ownership documents?

Non-specialists should not decide this themselves. Current information is confirmed through the notary and responsible registers instead of assessing copies by their appearance.

Is a particularly inexpensive listing suspicious?

Not necessarily, but it requires explanation. Condition, location, documents, pressure to sell and comparable listings must make the price understandable.

Can I rely on a power of attorney?

A power of attorney is checked for authenticity, form, scope and validity. The representative should receive no payment without this confirmation.

What should I do with contradictory information?

Contradictions are recorded in writing and clarified by the competent specialist bodies. Until then, no assumption is made in favour of a quicker completion.
